Our Practice Areas
Elder law
Elder law has become an increasingly popular term as Baby Boomers have begun reaching age 65. Issues that face our elderly population include planning for incapacity, long term care planning, real estate issues, tax planning, and passing assets at death. An experienced elder law attorney like Paige Freitag who is familiar with all of these myriad legal areas can assist you or your family member with understanding and tackling these issues.
Business FORMAtion & transactions
NOTICE TO BUSINESS OWNERS: The Corporate Transparency Act (CTA) beneficial ownership information (BOI) reporting requirements became effective on 1/1/2024. The CTA may require you to file information about your entity’s owners with FinCEN. You can find free information about complying with this law and filing your report at the official FinCEN website. We have posted an overview on our blog and you may contact us for additional information.
Once you have decided to take the step to open your business, having an attorney to advise you along the way is valuable. Erin Martoglio can meet with you to discuss specific questions you may have regarding your type of business, help you determine the best legal entity structure, such as a corporation, LLC, benefit corporation (or "B-corp") or non-profit, and assist you with forming the entity. Erin can assist in reviewing and drafting contracts and agreements, discussing specific issues that you may have in the context of your business, and advise you in purchasing, selling, merging or dissolving your business.
Estate planning
Estate planning is an important process that involves planning for what would happen to you, your assets and your family if you were to be incapacitated or upon the event of your death. Paige Freitag and Erin Martoglio are here to discuss your unique needs with you and to make the process as easy as possible.
Some of the most common documents that are created as part an estate plan are wills, powers of attorney, appointments of health care representative, living wills, and trusts. Both Paige and Erin can help you get your estate plans in order.

probate, estate and trust administration
When a loved one passes, you will likely have questions about what steps to take next even if your loved one had a will. We understand that this is a stressful time and our attorneys can help you determine what steps are needed in your particular situation. We can help you in handling the probate process or with administering an estate if there was no will.
In addition, our attorneys can help you with issues or questions related to the administration of trusts.
ASSET PROTECTION, Medicaid planning, applications & appeals
Many families deal with the uncertainty of how to manage the cost of long term care. While Medicare provides health coverage for persons age 65 or over, Medicare does not pay for extended long term care either at home or in a nursing home.
A majority of elderly who reside in nursing homes will need to turn to Medicaid to pay for their care long term. Medicaid is a means tested public benefit program which is governed by both federal and state law. The rules for obtaining Medicaid eligibility to pay for nursing home room and board or to cover some costs of care at home are complex. Medicaid has strict rules regarding the transfer or gifting of assets, and the rules and regulations change. Unfortunately the Medicaid application process is often unpredictable and challenging.
Paige Freitag can answer questions you may have regarding asset protection and long term care needs before you or your family member are in a crisis planning situation. She is here to provide facts and information to help you plan appropriately.

adult guardianships
Our attorneys are experienced in handling guardianship related matters. If an adult loved one is no longer able to care for himself or herself, or is no longer able to manage his or her finances, it may be necessary for that person to have a legal guardian appointed by the court. We can represent you in obtaining guardianship and in managing the responsibilities that come with being a guardian.

The whimsical design of our owl represents the creative approaches we bring to solving our clients' legal issues. Our owl is an original drawing by artist Justin Ecenbarger of Mulberry, Indiana.
